- SUMMARY OF STATE LIVING WILL LEGISLATION
-
- NORTH CAROLINA
-
- Synopsis: North Carolina has a weak living will statute. The
- law does not place an obligation on hospitals/physicians to
- effectuate the living will, but, does permit physicians to
- implement living wills. No form for living will is suggested.
- Consequently, any reasonable form, for example the "Weekend
- Law Firm" (TM) uniform living will can be used. Please
- also consider executing a living will for any State that you
- spend more than a few weeks per year, or where you are a
- temporary resident.
-
- Statute number: N.C. Gen. Stat. 90-320
- Statute title: "North Carolina Right to Natural Death Act"
-
- Governmental Agency to contact for more information: None
- specified
-
- A specific form of living will is not provided
-
- Witness requirements: None are specified by the statute.
-
- Recording of the living will is not provided for
-
- Means of revocation of the living will are not described in the
- statute. In general, a document which specifically revokes the
- living will is effective, further, destruction of the living
- will (tearing, burning) is also normally recognized as a
- revocation.
